1. Introduction

These Terms and Conditions ("Terms") govern your use of the Mofawings Tours and Travel website and services. By booking with us, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.

2. Booking and Reservations

2.1 How to Book

Bookings can be made through our website, by phone, email, or through our sales representatives. A booking is only confirmed once we have received your completed booking form and payment.

2.2 Booking Confirmation

Once your booking is confirmed, you will receive a confirmation email containing your itinerary, invoice, and payment details. Please review this carefully and contact us immediately if there are any discrepancies.

2.3 Accuracy of Information

You are responsible for providing accurate and complete information during the booking process. This includes your name, contact details, passport information, and any special requirements or medical conditions that may affect your travel.

3. Payment Terms

3.1 Payment Methods

We accept payment via bank transfer, credit/debit cards, and other payment methods as indicated on our website. Full payment or a deposit as specified in your quote must be received to secure your booking.

3.2 Pricing

All prices are quoted in the currency specified. Prices include the services mentioned in your itinerary but do not include visa fees, travel insurance, personal expenses, or items not explicitly stated as included.

3.3 Currency Fluctuations

If significant currency fluctuations occur between quotation and final payment, we reserve the right to adjust pricing accordingly. We will notify you of any price changes with reasonable notice.

4. Cancellation and Refunds

4.1 Cancellation Policy

• More than 60 days before travel: Full refund minus 10% administrative fee
• 45-60 days before travel: 50% refund of total package cost
• 30-44 days before travel: 25% refund of total package cost
• Less than 30 days before travel: No refund

4.2 Cancellation Procedure

Cancellations must be made in writing to info@mofawingstoursandtravel.co.ke. The cancellation date is the date we receive your written notice.

4.3 Refund Processing

Approved refunds will be processed within 14-21 business days to your original payment method.

5. Changes and Modifications

5.1 Changes by Customer

Changes to your booking are subject to availability and may incur additional charges. Changes must be requested in writing as soon as possible.

5.2 Changes by Mofawings

We may modify itineraries due to unforeseen circumstances such as weather, natural disasters, or safety concerns. In such cases, we will offer alternative arrangements or refund options. Changes will be communicated as soon as possible.

5.3 Force Majeure

Mofawings is not liable for any losses, delays, or changes caused by circumstances beyond our control, including but not limited to: natural disasters, political unrest, health crises, transportation strikes, or accidents.

6. Responsibilities and Liabilities

6.1 Our Responsibilities

Mofawings is responsible for providing the services explicitly stated in your confirmed itinerary with reasonable care and professional standards.

6.2 Your Responsibilities

You are responsible for:

• Obtaining valid travel documents (passport, visas) and ensuring they meet destination requirements
• Obtaining appropriate travel insurance
• Complying with all local laws and customs
• Following safety guidelines provided by our guides and tour operators
• Informing us of any medical conditions or special requirements in advance

6.3 Liability Limitations

Mofawings' liability for direct losses is limited to the total amount paid for the services in question. We are not liable for:

• Indirect or consequential damages
• Personal injury (except where caused by our negligence)
• Loss or damage to personal belongings
• Flight delays or cancellations by airlines
• Changes in itinerary due to circumstances beyond our control

7. Travel Insurance

We strongly recommend that all customers purchase comprehensive travel insurance covering medical expenses, trip cancellation, and personal belongings. Travel insurance is mandatory for all international bookings and is not included in our package prices.

8. Health and Safety

8.1 Vaccination and Health Requirements

Customers are responsible for checking and complying with all health and vaccination requirements for their destination. We recommend consulting your doctor before travel.

8.2 Medical Fitness

Some activities may require a reasonable level of fitness. Customers with health conditions must disclose these during booking so we can assess suitability. Participation in activities is at the customer's own risk.

8.3 COVID-19 and Health Protocols

Mofawings adheres to all government and health authority guidelines regarding COVID-19 and other health protocols. Customers must comply with all applicable health and safety measures.

9. Intellectual Property

All content on our website, including text, images, graphics, and logos, is the property of Mofawings Tours and Travel. Unauthorized reproduction or use is prohibited.

10. User Conduct

When using our website or services, you agree not to:

• Engage in any form of harassment or abusive behavior
• Violate local laws or customs
• Damage property or disturb wildlife
• Engage in illegal activities
• Attempt to hack or manipulate our website or systems

11. Photos and Media

Photos and videos taken during your tour may be used by Mofawings for marketing purposes unless you specifically request otherwise in writing.

12. Dispute Resolution

Any disputes arising from these Terms or services shall be governed by the laws of Kenya and subject to the exclusive jurisdiction of the courts of Kenya.
